The Bosman ruling: how one Belgian midfielder rewrote football

Aug 20, 2026 · 09:40

A forgotten midfielder's court case created the system in which every expiring contract is a news story.

Anyone who changes clubs as a free agent today owes it to one man: Jean-Marc Bosman, who took his club to court in the 1990s and won.

What happened?

Bosman's contract with his Belgian club expired and he wanted to move to France. Under the rules of the time, however, the parent club could still demand a transfer fee even without a live contract. The French club did not pay, and Bosman was left without a job in the middle of his career.

The ruling that changed everything

The European Court of Justice ruled in 1995 that a player whose contract has expired may move to another EU member state without a fee, because the restriction breached the free movement of workers. The same ruling also ended the quotas limiting the number of EU foreign players a club could field.

What were the consequences?

Power shifted towards players and agents. Clubs responded with longer contracts and release clauses, since a star with less than two years remaining loses value rapidly. A separate market for free agents emerged, where higher wages and signing bonuses replace transfer fees.

Why does it still matter?

Every summer, stars worth tens of millions change clubs for nothing. Behind all of those deals stands the same 1995 ruling - and the clubs that come out ahead are the ones that renew contracts in time.
